1. Agreement
By accessing or using Tofa you agree to these Terms of Service. If you do not agree, do not use the service. Tofa ("the Service") is owned and operated by Firstframe LLC, a US limited liability company ("we", "us", or "our"). Your use of the Service constitutes a binding agreement between you and Firstframe LLC, not any individual.
2. The Service
Tofa lets you create a personal wishlist at a public URL (gettofa.com/yourhandle) that friends and family can view to find gift ideas. You control what's on your list and who can see it. The Service is provided free of charge and without any commercial transaction between you and Firstframe LLC.
3. Account & Authentication
You may create an account using your phone number or email address. By providing your phone number you consent to receive one SMS containing a verification code. Standard message and data rates may apply. Reply STOP to opt out of future messages. Reply HELP for support. By providing your email address you consent to receive a one-time sign-in link. We do not send unsolicited marketing communications.
4. Your Content
You own the content you add to your wishlist. By posting content you grant Firstframe LLC a limited, non-exclusive, royalty-free license to display it to people who visit your public profile. You are responsible for ensuring your content does not violate any laws or third-party rights. We reserve the right to remove content that violates these terms.
5. Prohibited Use
You may not use Tofa to post illegal content, harass others, impersonate other people, or attempt to circumvent our security measures. Firstframe LLC reserves the right to suspend or terminate accounts that violate these terms, at its sole discretion.
6. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Firstframe LLC does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
7. Limitation of Liability
To the fullest extent permitted by law, Firstframe LLC and its members, officers, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the twelve months preceding the claim (which is $0 as the Service is free).
8. Governing Law
These terms are governed by the laws of the State of Wyoming and the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in Wyoming.
9. Changes
We may update these terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised terms.
